Payment and Refund

Your customised or pre-decided payment plan determines the cost of the project. Please note that the project fee is subject to variation due to various factors, including but not limited to its scope, milestones, deadline, or any other unforeseen circumstances.

Therefore, the fee for services will be based on the cost estimates provided unless the work exceeds the outlined scope. Additional fees will apply for excess work beyond the specified items. Quotes are contingent on timely provision of work to meet deadlines, and a 'rush' deadline charge may be applied. Moreover, please note that Tech Ciaga Pty Ltd cannot be held liable for any errors in such rush jobs.

A non-refundable deposit of 50% of the total project cost is required in the initial stage of the project. Please note that Tech Ciaga Pty Ltd will not release any backup files at any stage without receiving the initial non-refundable 50% deposit.

The remaining balance is due upon completion of the project and before the delivery of the final project files or deployment of the website. The remaining balance is due and remains valid within 7 days of final requirements being signed off.

Tech Ciaga reserves the right to discontinue services if the client has not made payment for outstanding invoices. The client is responsible for indemnifying the company for all costs, losses (direct or indirect), and any actions causing loss or damage in connection with the rendered services.

Cancellation requests by the client will result in invoicing for work or expenses completed up to that point. Invoices are strictly due within 14 days. However, jobs spanning an extended period will be invoiced progressively. Estimates must be signed before work begins.

Invoices will be issued electronically and sent to the client's designated email address. Any disputes regarding an invoice must be communicated within 7 days of receipt. Failure to do so will be considered as an acknowledgment that the invoice is accurate.

Furthermore, written acceptance of quotes is absolutely vital, and all verbal acceptances will be confirmed in writing by Tech Ciaga to maintain the company’s official records. Please note that only with your acceptance of the quotation will our team begin working on your project, and such an acceptance also implies adherence to our terms and conditions.

Clients may request a refund for their services within 3 days of the commencement date of the project. However, the 50% amount deposited at the start remains non-refundable under all circumstances.

We accept payments via credit/debit cards, bank transfers, etc. However, details for each method are clearly communicated before the start of each project and may be elaborated upon request.

Indemnification

You're on board with covering TechCiaga Pty Ltd, along with its affiliates, officers, employees, and agents, from any heat that might come from your User Content. This includes things like claims of infringement, defamation, or stepping on someone else's rights.

You're also up for standing guard and protecting TechCiaga Pty Ltd from any third-party claims that say your use of the services breaks the law.

Limitation of Liability

As far as the law allows, TechCiaga Pty Ltd won't be held responsible for any sneaky damages that come your way. This includes things like indirect hits, special circumstances, or even the loss of profits or data because of:

  • Your use (or inability to use) of the services.
  • Someone poking around where they shouldn't in our servers or nabbing personal info.
  • Interruptions or hiccups in the service
  • Other bits and bobs that are just part of the deal.

Governing Law
